just want to check...........

My ex and I have been seperated for the last 16 months. I moved out of the house and went into rented accomodation with our children and I am currently in receipt of housing benefit, income support and tax credits. For the last 2 months my ex and I have been 'seeing' each other again (going out on dates etc) and he has stayed over at my house once (kids were not aware as I made him leave in the morn before they got up as I don't want to confuse them anymore than they probably already are). Anyway my question is, am I in breech of my benefits? He doesn't support me financially (except for child maintenance) but I'm not sure how I stand in this situation as he is not a new partner but the one that I originally split up with. Feeling confused as I'm not ready to say that we are getting back together completely as it's too early days to make that decision yet but I don't want to get into trouble either. Can anyone advise? Thanks

    You are not living together therefor you are not doing anything wrong. If he moved back in and you didn't tell anyone that would be different.

    When deciding if 2 people are living together as man and wife for benefits, they look at things like joint bank accounts, bills in both names, etc.

    From what I can gather, this doesn't seem to be the case with you & your ex.

    Put the question to your benefit advisor and see what they say. That way you have a definate answer. This one comes up time and time again so tell them and see what they tell you.
