Parking Ticket, Glasgow Silverburn, Town & City Parking Ltd

Hi,

An elderly friend I know has been given a ticket at the silverburn Centre in Glasgow by Town & City Parking Ltd for parking in a disabled bay. He doesn't have a disabled badge, I don't know why he parked there, maybe he didn't realise or was just taking a chance. I don;t want to get into a debate about the rights and wrongs of using disabled bays.

Basically, can he just ignore the ticket. He's a little worried and is planning to pay up. I'm under the impression that the onus is on the company to prove who was driving the car and if they can't prove that you don't need to pay.

Does anyone have an experience of with this company or carpark?

    This company is well known on here and can safely be ignored. If you look at the top of this sub-forum on the thread entitled "PPC Letters/Threats: What to Expect" ,you will see the letters that will be sent out by T&C Parking Ltd. They look a bit scary but ultimately they are meaningless and just hollow threats.
    What part of "A whop bop-a-lu a whop bam boo" don't you understand?

    The reason your friend parked there is because there are loads of empty disabled spaces, tempting to everyone else who has to park an excessive distance away, might just be me but could this be a deliberate ploy to try to entrap people????

    Ok, disabled spaces. The general rule is that disabled spaces in private car parks are totally unenforceable, whether it is supermarket or shopping centres, so can safely be ignored.

    However, as you are in Scotland, things ARE slightly different(but don't despair as this is for your info only).
    Legislation has been passed in Scotland to allow disabled spaces on private ground to be enforceable. This requires the local authority to monitor,approve and enforce the space in question. Therefore ONLY the local authority can ticket you for parking there and not a PPC. As the PPC looking after a carpark will not give up their supposed jurisdiction to the LA for any spaces within the carpark I am unaware of any agreements being reached which make any of these spaces enforceable. Edinburgh are looking at some but as yet not taken any over.

    Tell your friend to safely ignore Town & Country, do not contact them in any way shape or form.

    Ironicaly Silverburn was the example that was used in the press when the new legislation for Scotland was reported ;)
