I think all that you have said above goes for loads of people that had SIngle Premium PPI's added to their agreements. As regards not being served with a copy of the policy are you on about the terms and conditions of the PPI or an actual copy of the policy?
Did you agreement not have a cancellation right written where you actually sign?0 -

Hi Marshalka,
PPI policy :- Was never sent to me until I requested it 3 years after signing the agreement.
If they had told me at the point of sale, that they were going to purchase a policy, in their name, from an insurance company, I may have not agreed to the transaction.
Cancellation Rights Notice :- This is exactly what is written on the contract.
IMPORTANT - READ THIS CAREFULLY TO FIND OUT ABOUT YOUR RIGHTS.
The Consumer Credit Act 1974 lays down certain requirements for your protection which should have been complied with when the agreement was made. If they were not the creditor cannot enforce this agreement without a court order. The Act also gives you a number of rights: 1) You can settle the agreement at any time by giving notice in writing and paying off the amount you owe under the agreement which may be reduced by a rebate. Examples indicating the amount you have to pay appear in the agreement. 2) If you received unsatisfactory goods or services paid for under the agreement, apart from any bought with a cash loan, you may have a right to sue the supplier, the creditor or both. 3) If the contract is not fulfilled, perhaps because the supplier has gone out of business, you may still be able to sue the creditor. If you would like to know more about your rights under the Act, contact either your local Trading Standards Department, or your nearest Citizens Advice Bureau.
So in essence, there is no cancellation rights notice, no mention of a cooling off period, and no advice on how to access the CCA 1974 by which the agreement is regulated.
I am wondering if clause 2 is legal under the CCA.0 -
Hmmm, what are you going to do about then? I take you focusing in the loan that paid the PPI and not the PPI itself so this becomes a consumer credit complaint and not a PPI complaint?0

Yes, my situation is rather complicated for now.
Although I felt I should post in this section because of the PPI element. There must be thousands of agreements like mine out there, so it is not as though NR do not know where their shortcomings are. The FSA sent out a request to the major finance companies recently, more or less telling them to put things right. Some companies are writing to their customers offering to do this, but some are not. I am almost certain that the agreement is unenforceable, and they have been quite arrogant in their dealings with my questions and complaints.0 -
Just thought i would update my original thread to say that Northern Rock sent me a letter this morning offering me £663.68 plus 8% interest of £145.84. :j
They say that they are not satisfied that their sale of ppi met all their standards of service. They are also knocking 11 quid off my monthly payment.
I just want to say thanks to everyone on here who gave me advice and the encouragement to pursue my claim. 2 more claims in the pipeline i hope this only just the start.:T0 -
