Some Advice Please!

Options
Hi, I am new to this forum so first of all, hello to everyone.
My situation is as follows.
I was made redundant on the 9th of September just gone. I had worked for my employer for just over 3 years. I was asked into the meeting room at 5pm on the 9th September, told I was being made redundant and that I had to go there and then. I walked out of my office 10 minutes later.
The business is an independant Estate Agency employing 7 staff and I was employed as the Sales and Lettings Manager. My contract of employment states that 3 months notice is required on both sides to terminate employment. I have received 3 weeks statatory redundancy pay plus an extra 1 months pay.
I have written to my ex-employer stating the discrepency in pay to which he replied that he had a contract that stated 1 months notice. I asked him to send me a copy which he has but...........all it is is a copy of the original that I have, to which he has crossed out and initialed the change to 1 months notice!
Before I take this any further I would like your opinion on two issues. One is the way in which I was made redundant. Was the correct prodedure used?
And two, any thoughts on the change to the contract?
Regards
Dean

Hiya, Your dates are quite similar to mine as it happens.

This is what happened to me.

At least six months ago, maybe alot more, everybody in the company (around 40 of us) was given a letter, stating that there might be redundancies due to loss of contracts. These contracts were up for renewal six months after this date.
With invites of input as to how the company could go forward.

On or around 11th of August, I was informed that I was to be put on a 1 month consultation period, with a view to redundancy after the 1 month period, but certainly not at the end of that month nor any time straight after that. During that month I could go to them with any concerns and them to me.

To cut a very long story short, I was quite happy to go, and finally went on 2nd September

I'd been there for 3 years and received, three weeks pay and holiday pay due.

I'd have a word with ACAS if I were you ;)

He cannot unilaterally change your contract. Speak to ACAS.

Did you get paid for your accrued holiday.

Are you under 41, redundancy pay changed at 41 to 1.5 weeks.

Go get em, I hate this sort of thing. Let us know how you get on.
make the most of it, we are only here for the weekend.
and we will never, ever return.

Any fool can cross out something in a contract to make it suit him better and initial it for himself. In fact only a fool would do such a thing. It counts for nothing except a hard fight for you. Threaten to take it to the employment tribunal, send a copy of the contract you hold, giving him 14 days, don't mess about after that - take it to the ET. Remember you have just 3 months to do this - not sure when the clock starts ticking.
