Bloody cheek

has anyone heard of buckananclark + wells, we got a letter from them today addressed to mr&mrs*******in bankruptcy. so everyone will now know about us now as i dont suppose the postman will keep quite about it. what i want to know is are they allowed to address a letter this way and even if they are why are they sending me letters to demand money when they obviously know i am bankrupt.

    Yep. I've heard of them.

    A particularly 'bottom of the pond' firm of debt collectors.

    They shouldn't be addressing something like that.

    Although technically bankruptcy is a matter of public record, so it's arguably not a breach of data protection. But it is an unfair and oppressive for them to embarrass someone in that way according to the OFT, so probably deserves a complaint.

    They shouldn't be demanding money from you regardless, so that is out of order completely.

    Hi,

    I would just send them the standard P*** off letter I am sure someone posted it on one of the links yesterday, the one where it mentions harrassment etc.

    I have dealt with them before not for me but someone who used to live at my address they can be abit pessistant if you don't nip it in the bud.

    I can confirm that they are indeed one of the industry's worst.

    I think this is deserving of a complaint. Although, as has been mentioned, they're not technically in breach of data protection as bankruptcy is listed in the Gazette. It could be argued that the small readership of the gazette is specialised in that field and otherwise it has cost you humiliation and libel.

  • I worked in telephone collections and the letters that go out are a different department that we weren't even allowed into. They were like secret moles in the lower offices. But it is absolutely typical of BCW's aggressive approach to collecting.

    The day I left was when I was on a call to an OAP and I was collecting a gas bill. The debt was £600 and the OAP was very distressed, stating that she didn't know why she had the debt as she had a prepayment meter. I told her to hold the line and contacted my supervisor, who told me that "mistakes like this are common; but try and pursue it anyway". I handed over my headset and never went back.
  • got a phone call from this lot again today the guy on the phone says he was chasing a debt to o2, i told him that we are bankrupt as of 25th august and that o2 were declared in the bankruptcy so he says that this is dated 17th sept and so i must pay or they will take further action. of corse i fought my corner telling him he was talking rubbish i offered to give him the name and address of the or but he wasnt interested, he siad that the or can get in touch with him. anyone got any ideas should i bother the or with this as they are talking c*** or should i pass it on.

    Just leave it. You told him about the bankruptcy, its not your fault he ignored it.
  • If they ring again then you start having fun with them. Go through security and when they start explaining, interupt and say there is someone at the door and you will be back in a mo. Put the phone down and go off and have a cuppa and a biscuit for half hour. While you are doing this they are wasting money on the phone call, paying the person for doing nothing, they are not harrasing some other poor soul and they can't use that phone if they do hang up as the line is still open.
