what benefits am i entitled to? please help

hi i am currently on income based ESA and i have finally just been awarded DLA mobility and care i live in a mortgaged house with my partner who is trying to claim carers and that is all we claim

oh i forgot to mentioni have a son age 2 who i get £20 s week child benefit and £40ish for tax credit

i ws wondering if people could advice me please

    Hi tripp_989, if you could give more information about your situation I think it will help people here to advise.

    As your partner is making a claim for CA you are receiving DLA care rate either mid or High rate aren't you? There are Disabled Premiums if you are on MIDDLE or HIGH rate, I'm not sure of the rules when you have a partner as I receive premiums but live alone.

    Does your partner work? As you have a mortgage, you may be entitled to help with mortgage interest payments, but this depends on your situation. Also your may be able to get help with Council Tax relief.

    Speak to your ESA BDC about mortgage help. As I understand it you can get help with your mortgage after 8 weeks of claiming.
    He won't get carers allowance if you are on the low DLA rate.

    You may find that because your income may have gone down, you may get more child tax credits.

  • hi thanaks for all replies i am getting dla care middle rate and moblity high i get no help with council tax i do get help with mortgge interest my parter is not working looking after me hence applying for carers

  • ESA - You will have no entitlement to SDP as you have a partner (unless he is also getting DLA care component higher or middle rate and nobody is getting carers allowance for looking after you or partner) You will have no entitlement to EDP as you dont have high rate DLA care component... however if you are awarded the support group after your WCA (work capability assesment) then you will get EDP. If your partner is awarded carers allowance ( 53.90 )then this will be taken into account on your ESA award altho you will get a carer premium of (30.05) so you will be about 23.85 better off if carers allowance is awarded to your partner.
    After your WCA you will either be found fit for work and disallowed ESA tho you can can string this along by putting in appeals or you will be awarded the support grp component of 31.40 or the work related activity grp component of 25.95. If you are put into one of the groups then you no longer need to submit medical certificates you will tho have a further medical in either 3months 6months 1yr 18mnths 2 yrs depending on what the ATOS consultant recommends.

    Apply to the council for Council Tax Benefit

    Apply to the ESA BDC for mortgage help

    I'm not sure of the rules of council tax in your situation but I would think that as your partner isn't working either and you have no savings, I would think you would be eligible for council tax help. Have you tried applying for council tax?
