Mortgage PPI missold by broker?

Hi all,
I've just noticed that for a year I've been paying £50 a month for Buildings Ins. and PPI that I didn't agree to sign up to.
I signed up for a Halifax mortgage through a broker, we discussed PPI and insurance and I declined to take it up. My keyfacts about the mortgage that the broker gave me shows this section blank with no monthly costs. Looking through my mortgage paperwork that the missus stuffed in a drawer I can see that I've been signed up to a company called PaymentShield. I certainly didn't ever sign a direct debit mandate for them, yet they're taking money out of my account.
I've put in a call to my mortgage broker, they're going to check their records and let me know what their paperwork says I agreed to. In the meantime I've cancelled the direct debit.
Surely I'd be entitled to claim back the money that I've paid for this over the past year if I can show that I didn't agree to it. Who would my first point of contact be on Martin's PPI reclaim list? If the broker confirms that I didn't sign up to it would I go straight to Halifax?
Thanks a lot for reading :T

Hi there
You always pursue the ones who set up and sold you the policy.
I will leave this one for Dunstonh who will be along at some point I expect and will give advice on this for you.
Good luck. The one and only "Dizzy Di"

Which it should do. You were not buying the product via Halifax so they would not include it.I certainly didn't ever sign a direct debit mandate for them, yet they're taking money out of my account.
Like most general insurance (and many other things) you dont need to sign anything any more.urely I'd be entitled to claim back the money that I've paid for this over the past year if I can show that I didn't agree to it.
If the broker has a compliant audit trail then they should be able to reject your complaint easily.
You would have been sent a policy schedule, details of direct debit and payments, cancellation rights and statement of demands and needs. Most of these coming from paymentshield with some from the broker. So if you can explain why so many bits of post havent been received by you then you may have a case. However, if you cant and the mortgage broker has a good file (ie copies of what was sent and can verify you were eligible for cover and had a financial need) then its going to be hard for you to win your complaint.Who would my first point of contact be on Martin's PPI reclaim list?
The broker. However, do be aware that you would be burning your bridges with that broker (and possibly other local ones if they share details). If the broker confirms that I didn't sign up to it would I go straight to Halifax?
Halifax have no liability. They didnt provide advice to you.I am an Independent Financial Adviser (IFA). The comments I make are just my opinion and are for discussion purposes only. They are not financial advice and you should not treat them as such. If you feel an area discussed may be relevant to you, then please seek advice from an Independent Financial Adviser local to you.0 -
Many thanks for the reply dunstonh, not exactly the news I was hoping to hear, but at least I'll be a bit better informed when I speak to the broker again tomorrow! Annoying thing is that I clearly remember the conversation where I declined PPI and buildings cover through them.
My girlfriend was living at the house for the first few months, so all the mortgage related post just got shoved into a drawer. I've dug through it now and sure enough I did get a letter from PaymentShield. Ah well, I'll see what the brokers say tomorrow, live and learn and all that
