Do I wait for ESA appeal or submit new claim?

I wonder if someone could explain the ins and outs of ESA - Contributory claims please.

The ESA medical was a failure - 0 points - and an appeal was sent in. The appeal date is going to be in the middle of next year.

The assessment rate is now being paid.

What I would like to know is this:

Based on the National Insurance contributions record, no claim for ESA can be made next year. One for this can be made.

As the appeal won't be heard until say June 2011 and if it is also a failure, then an new contribution claim cannot be made.

Can one be made this year to protect the possible failure for next year? If not what is the best way to do this - to make sure that a valid claim is in force - not just the one for the assessment rate?
