Provision of personal details by DVLA when not entitled to be requested

I note from "please read before posting" that a private car park company can write to the DVLA to obtain the personal details of the registered keeper of a vehicle. If this is supplied and it later transpires that the company were not entitled to request this information is there any redress on the DVLA or on the car parking company? Presumably it is a breach of the Data Protection Act?

I ask because a no doubt overenthusiastic attendant ticketed the car when it was actually outside the car park on a public road!

  • I've been wondering the same thing..it does seem to breech data protection, can't say that I'm too happy with that, way too easy for them to obtain personal information

  • First give more info on the alleged offence. You have first to prove the ticketing illegal then you can start going further, however proving things would be more problematical.

    Ignorance is bliss and brings in the money. I am sure the DVLA say they will take action or prevent access to the database if it is misused, however I am guessing that they have never taken action against anyone and are happy the money keeps rolling in, and will spout a canned ignorant blah de blah we are allowed under etc etc response if you complain. Even worse I believe there are some companies who acquire data from DVLA for third parties. I.e. PPC pays third party company, tp company gets data from DVLA and gives to PPC. All very dodgy, and sadly I doubt anything will be done to prevent it anytime soon.

    There is also the case of someone's details being divulged by the DVLA when they themselves own the land the car was parked on. https://forums.moneysavingexpert.com/discussion/2691319

    The DVLA passes on the DPA liability to the requestor.

    And obvious resulting question, what does this liability entail. What type of punishment could a PPC abusing the system expect and how would someone go about ensuring they received that punishment?
  • Personally I think we should concentrate on getting the details the OP alludes to first. Its well known that Ranger Services will get RK details for any ppc at a price.
