relationship break down, advice needed for housing

    I really don't understand why Mrs Munch continues to want to leave the property now it's been determined that she is extremely unlikely to secure council accommodation. What precisely is her problem with remaining in the family home compared to the insecurity of tenure that comes with private rental?

    Mrs Munch should get legal advice on Mr Munch's obligations - it seems she's agreed to waive some kind of support to get her debts written off but expert advice would be better. What do they mean by 'maintenance' anyway? He must pay child support.

    with all debt tats being serviced..

    Think unfortunately only couple options remain:

    1. Mr and mrs munch continue to live together ,unhappy and work on paying mortgage and debts off.

    2. mrs munch leaves to private and gets into more debt eventually being forced into a debt ridden life or bankruptcy

    3. Mr and mrs munch owe up to fact debt that is 'serviceable' is not necessarily good... i.e. forever having no money is not a good thing and work together to repay debts.

    4. mr and Mrs munch take an easier approach, renege on mortgage all together, hand keys back to bank and go their seperate ways taking on indebted negative equity anf other debts... eventually both go bankrupt. Years after they work to restore credit they try to not get into debt again and only spend what they have.

    Unfortunately there is no easy fix, with negative equity and other debts you have no money, you both have negative cash... there is no gain in keeping house in my opinion.

    By the way, Mr and Mrs Munch should seek expert advice on their debts, too, to make this more manageable. The Direct Gov website and the Debt Free wannabee forum on MSE are good starting points to get the best solution and strategy to deal with them instead of getting overwhelmed by them.

    Mrs Munch has her reasons for wanting to end the relationship and leave the property, I wont go into them here as they are personal to her. If its any help Mr Munch would do the same thing if he was in Mrs Munch's position. She cant achieve what she wants to achieve if she stays, unless Mr Munch goes, which he was going to do until Mrs Munch decided she would leave!

    Mrs Munch will not get legal advice unless she is unhappy with what she and Mr Munch agrees between themselves.

    To Neas's options:
    1. wont work due to what Mrs Munch wants to do
    2. Mrs Munch would actually be better off in the private rental as her tax credits would increase and other benefits become available.
    3. Mr and Mrs Munch will be working together to pay off the debts, although Mr Munch will be more active on this so that Mrs Munch has enough money to treat Baby Munch
    4. There is no way Mr Munch would give up on paying back the debt he has accrued and he accepts it will be a long slog to do it. Repossession or Bankruptcy is not an option.

    Housing Benefit is means-tested and her income would be taken into account in deciding any amount of HB that might be due.
