If the bank are refusing to pay out and her claim meets all the requirements of section 75 then the next step would be to complain to the financial ombudsman.A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -

Before she goes to the Financial Ombudsman, has she made an official complaint with Barclaycard? , as until she has exhausted their complaints process the Ombudsman won't get involved.
This means 8 weeks after complaint (or earlier if Barclaycard submit a final response).
I appreciate you've been waiting a lot longer than 8 weeks, but if all previous contact has just been with customer services it won't really count.

That depends - if you have any evidence that you told them you were not happy with the way Barclaycard were dealing with it then the eight weeks started when they received it - which would be deemed to be two working days later.
If you have, I would be tempted to write to Barclaycard with a copy of that, point out that the time limit expired on whatever date it was and that they are in breach of FSA rules (or that it will expire on whatever date if not).
Give them to the end of the period required or two weeks - whichever the longer.0
