Unenforceable credit agreement

Hi all,

I have now had one of my credit cards deemed by the court as unenforceable, great i though! :j

only, where does this now leave me?
the Debt is still there and owing, only the lender can't take me to court now, big cheese, i can still get a bad credit reference as non payment will go down on my record and late or non payment....

what's my next step?
i see many people are asking is it a scam etc, the company i used managed to get one of my cards through (Alliance and Leicester MBNA) but not another (MINT)

can anyone help, has anyone got an unenforceable card they are not now paying???

    Basically, you now live without credit for the next 6 years or so. Or at least, any credit outside of the sub prime market.

    It leaves you as one of the large number of people who think they can run up debts by spending other people's money and then get out of repaying what they knowingly and wantonly spent.

    Wait until you try and get a mortgage or further credit................

    i have been paying repayments on my card for the last 8 years, never missing a payment, the unenforceability idea came along and thought if i have to play by the rules, then so do the banks...

    i may carry on paying my repayments, but wanted to hear from anyone else in the same boat.

    I'm afraid all you will get here is abuse from people who will tell you how wrong you were to spend the money, run up the debts and abuse any kind of financial system

    I do think that celebrating the fact your card is unenforceable hasn't helped your situation....

    Well, you keep paying your debts. You openly admit the debt is yours, still there and owing. So why wouldn't you pay it?

    unenforcable debts are a way for people who can't afford to pay their debts to avoid being taken to court by the lender. The debt is still registered with CRA's and if you stop paying you will still get a default, so ruin your credit rating.
    Debts at LBM (May '08) £5760 - Lloyds CC £4260, Lloyds OD £1500;
    Debts as of May 28th 2011:
    Santander CC: £0.00
    Lloyds OD : £0.00

    How about providing a few more details on how it was deemed unenforceable ? On what basis was the judgement made and in which court ?

    I used a company in Sale, Manchester called Red Star Financial Management.

    The cost was £399 per case ( i had 2)

    the lender could not provide an agreement within the time scale (they never bothered to even reply) this was asked for twice, then was judged at court.

    Yep, you've got out of paying but the fun with your credit rating will now begin.
