Thanks for reading this i know its long and a bit rambley, i hope someone can help me!!!
In my household theres my husband and I and our 3 children who are aged 3,8 &10
My husband lost his job in Feb this year and has since been signing on and recieving NI credits only due to me working 20 hrs.
On 03/09/10 I lost my job, my husband contacted JCP who asked him to complete a change of circs form also we notified HMRC re tax credits.
Since then HMRC have still been paying us the same amount of tax credits we usually recieve which works out about £190.00 pw while weve waited for our JSA claim to be sorted out.I have also received my child benefit and my final wage which totalled £277.00 on 03/09/10.
We recieved our first payment today along with a letter saying due to my wages and also that we are still in reciept of tax credits until 29/10/10 we would be paid £49.00 per week but this is from 29/09/10 not 06/09/10 when I put the claim in.
So I'v just called them and they said thats right because our money starts after I got my last wage, not from when I left work, but that doesn't sound right to me as I was only paid for 3 days + 7 hrs overtime which was owed to me.
Can anyone shed some light on this, ive been told someone from the BDC will call me back

If you work for less than 24 hours a week as a partner of someone on JSA, the Benefits Delivery Centre take any earnings into account when you are paid rather than when you do the work. So they would have deducted your wages from the benefit week (this runs from the day after your husband signs on to the day he signs on i.e. if he signs on on a Tuesday, it runs from Wednesday to Tuesday) in which you were paid. This does mean though, that you should receive a higher amount for the weeks after the 3rd when you were out of work and did not receive any payments. Have they sent you another letter detailing how much you will receive for the dates prior to the 29/9 or is it possibly included in the same letter?0

Hi, can't help you regarding your current query, but this bit of what you wrote jumped out at me ...
Was your husband only assessed for income based JSA, or had he not made enough NI contributions to qualify for contribution based or already used up his 182 days worth ?Google is my friend ..... :j0 -

The BDC have said that because I recieved my wages 30/09 the fact that I was only paid up until 03/09 it makes no difference.
They've said that because I picked up £277 this cancels out any entitlement. They mentioned about it beind a pay period when i queried the fact that if i happened to be paid weekly then my last wage would've been on 03/09 or shortly after but they still said no grrrrrrrr
My husband was told he hadnt made enough class 1 contributions to qualify for conts based JSA so he had to claim income based but because I was working my wage was too high he didnt get any payments

What are the periods that your husband was in paid employment (not self employment) from April 2007 to March 2009?
You need to continue to chase the issue about receiving the payment, its been a long time since i worked in benefits but AFAIK this is wrong, it means you are actually beign treated as paid/working twice! Perhaps you shoud put your query in writing to the BDC manager (name should be on paperwork from them), that way you have evidence of reply and could then get help from CAB."You've been reading SOS when it's just your clock reading 5:05 "0 -
Thanks for the help, I actually left DWP new claims in September so I know a bit about how the system works and thought I was right. Unfortunatley when i called the BDC i got through to the most unhelpful woman on the planet who didn't seem to understand what I was saying.
I explained it to a lovely lady in the jobcentre today, who also thought it sounded wrong so im gonna fill in an appeal form tomorrow and send it off with a little letter to explain the situation further.
