Eviction

the landlord is evicting my mum under the section 21 notice and the last day was today. I understand that the landlord has to get a posseion order, im not sure how long thats gonna take? im really worried we have been looking for emercency accomodation, with no luck. unfortunaly i didnt pass my 1yr at uni and now live with my mum, since im an adult most places give priority for a mother and child. my mum is on housing benifit, and she was told by the council that we are not priority for a council house. we have two siamese cats that we love to bits. we have looked for emercency accommodation, the problem is that they dont want pets and suggested giving them to the rspca our cats cannot be send away! they will be tramatised they sleep with my mum and think that she is thier mother no one will ever love them as much as we do so thats not an option!! and the longest you can stay is a week. am i entilted to housing benifit?, because we need enough money to get a deposit to rent a house. mum has got four interviews next week so things could turn around for us we just need house right now :(

    I know it's not ideal, and that your main problem is your lack of a house, but worst case scenario, maybe you could get someone to temporarily look after your cats until you and your mum are settled, then you could get them back again, even if they did have to live elsewhere for a short while. I am sure that I have seen ads on my local Gumtree for things like this, where owners will pay for food and cat litter etc, if a fellow cat lover can look after their pets during an emergency situation. I think that some cat charities can also help with emergency temporary rehoming where a pet owner is having a hospital stay etc.

    I have pets and I know how difficult it is - but the reality is you cant keep your cats safe if you have nowhere to live.

    Have you enquired at the council about a rent deposit scheme for renting a property? You may be able to find a landlord who will take you, but I would suggest you get the rent paid directly to them and then you cannot fall into arrears.

    Try asking at the local cat rescue places to see if there is anyone who can foster the cats for a while. Both of you should be entitled to claim benefits, have you not made a claim for JSA? If you do that then your housing benefit claim should be done at the same time. It will take time though, so you need to ring the council today or go and see the CAB and get them to help you, they can negotiate with your landlord to give you some extra time, or help negoiate with the council.

    Do you owe any rent money to the landlord? If the property is in England and Wales and there has been a tenancy dating after 06 April 2007, has the landlord put the deposit in a tenancy deposit scheme? How long has she lived there?

    Contact Shelter asap and look at their sections on homelessness and eviction to understand how a local council is obliged to process your homelessness application. They will tell you your rights and options. Book an appointment with your local Citizens Advice Bureau.

    Some animal charities offer a fostering scheme. Many local councils offer deposit guarantee schemes.

    The eviction itself will depend on the waiting time for cases for the local court once the landlord applies for a possession order. This can be anywhere from 2 to 6 weeks depending on average waiting times but I suspect the local courts on average take a month to hear a case. Then typically if the landlord is awarded possession (which they will do automatically if the S21 has been served correctly), then I believe the judge will order the tenants to leave in a few weeks time but this can be extended if the tenants make a case for longer time in the property. If you still refuse to leave, the landlord goes back to the court to get bailiffs to enforce it. Again, their availaiblity depends on demand and could take a few weeks. The Shelter website, and perhaps the local CAB office, are your best bets to confirm the process and timelines as mine are rough estimates.
