I wonder if anyone can help pls?
I separated from my husband at the beginning of July he moved out. I have 2 kids aged 8 and 5. The 8 yr old is reg disabled in receipt of mid rate dla for caters and I get caters allowance for him.
I don't work and currently am in receipt of income support, tax credits and my maintenance money for the kids.
I have a new partner now and if he was to stay a night or two with me in my house is that ok? Is there a min or max to the amount of nts he can stay in a week? He has his own house, mortgage, bills etc and does not contribute to my expenses. Thanks

There is no min or max amount of time - even those on benefits are allowed to have a life
as long as he does not contribute financially or take out any credit at your address then you will be fine. 0 -

There is no set rule about how many nights he can stay. Anyone that tells you there is, is wrong.
To be classed as a coule (and hence loose your entitlement to Income Support) their are a number of factors they consider.
They may look at :
1) Do you eat/shop together (and hence share/pool resources)
2) Do you have any commitments together (eg loan, holidays etc)
3) Does the other person maintain another address (sounds like he does)
4) Public recognition (knocking on next door and saying "does she have a partner")
5) Children etc together.
It sounds like your circs sound fine, but be wary of being classed as a couple with your dependancies or being shopped in.
I would also say that a person on a low income and relying on the state (like you) should really be asking a regular visitor to help out with costs he is using (food, showers etc). Though this mindset seems alien to most, its common sense to me.
Regards.
