Is it illegal to sell a property without a gas and/or electrical certificate?

I am selling my property and am getting near exchange. The boiler at the property is probably 20 years old and was installed (I think) by the previous owners.

The people buying the property have already been told that no certificate can be provided for the boiler and we negotiated a significant price drop.

Is it illegal to sell a property without a gas and/or electrical certificate? Also if the boiler was to break in the mean time would that change anything? Would we have to inform the buyers?

    No.
    The property should be in the same condition at Completion as it was at Exchange, so yes, if it breaks down you need to fix it.

    No.

    Similarly, it's perfectly legal to sell a car without a service history.

    You took hit on price due to a boiler?how much?why did'nt you just get it serviced/checked and provide that as documentation.

  • It isn't a legal requirement. But if I were you I would have just had the boiler serviced (£50-£100) and then you will get a Gas Inspection Certificate to prove it is safe and in full working order. We are just selling our house and the boiler is an old warm air unit from 20 years ago and after a service the engineer said it passed with flying colours.
