Hi all,
I know I know this has been covered somewhere before...
My girlfriend got a ticket for over staying by 28 mins on a free parking for 1hr 30mins. I am not stating who the driver was but you know what women are like shopping.;)
Its a parking charge notice on a privately operated car park from Excel Parking
Just for reassuarance to her -
1 - ignore everything.
2 - we don't have to say who was driving.
3 - there is a small picture that doesn't show the driver - that proves nothing
4 - sit tight dont worry!
5 - if it goes to court - I'm confident it wont - it has to be small claims so less than £300?
Thanks all just trying to calm a worried young lady down who has her visa card ready and we can't afford to give away £60 or £100

Because all council parking terms and conditions are laid now in proper legislation. This is unlike private parking tickets which rely on the civil law of trespass or contract. Civil law clearly states that the "wronged party" can only claim for the actual loss suffered and not some arbitrary penalty.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -

You would think they would be subject to similar rules as banks are for example, charging stupid overdraft fees has been tightened up credit card late payments fee's etc.
Maybe there's something to bring up with watchdog there too lol,

They charge this type of amount as its large enough to make a profit and small enough so that the majority of victims pay without query.I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.0

You could say the same thing about any criminal law. Is two years in prison for stealing a couple of hundred quid considered a penalty that bears no relation to the amount of money taken? That's the difference between criminal and civil law. The bank overdraft question has nothing to do with criminal law, like private parking it's all to do with the civil law of contract.What part of "A whop bop-a-lu a whop bam boo" don't you understand?0 -
