Trying to reclaim PPI

Hi all,

I recently sent off a letter to Cap1 (courtesy of this site) requesting my PPI payments for a potential reclaim. I read the article on MSE, downloaded the template and sent it off.

I thought I had applied online but when they sent me back the paperwork I had actually applied in writing and (stupidly) had ticked the box for PPI when applying! :mad:

Is it worth me trying to claim? Do I have a case at all? I know Cap1 have been stung for this so I thought it may still be worth a try?

    Was it an application form for a loan (I take it you completed this at home then)?

    What year did you take this out?
    And was the policy ever discussed with you?

    If this was taken out after Jan 2005, the policy should have been explained to you, and you should have received the terms & conds of the policy soon after you taken this out in order to be able to cancel by the first 30 days, which is the cooling period.

    But you can always write back and ask them to reconsider if you have reasons for being mis sold.
    If it was a single premium and the ppi was paid upfront with the loan, then I think you should write back, because these are frowned upon and not always explained to the customer on how it works.

  • Thanks for the response. It was on a credit card and was taken out August 06. I did probably get the T&C sent but I really do not remember. I think I will try anyway as I don't really have anything to lose! Thanks again

    Di, how can you say that the policy should have been explained to the OP when they filled it in in their home and they ticked the box (as the OP says "stupidly" ticked it!!). This was not an advised sale as it was "chosen" by the OP to take out and therefore its up to the OP to read the terms and conditions.

    The only way the OP will be able to reclaim really is if the insurance did not cover in some way and then its difficult as it may have had exclusions in the policy and by ticking the box for having the PPI it most probably said that "you are ticking saying you have read and understood the PPI".

    Yes good point Marshallka, with no forms of verbal contact after application was made, so no discussions taken place of the PPI.
