17 year old, can he claim HB

17 year old living in girlfriends house ,his girlfriend is only 15 so he has own room buys his own food, receiving income support and soon ema when he starts course can he claim hb towards the rent he pays for his room

    Doubtful. For lots of reasons.

    Is there an official tennancy agreement between the 17yr old and his gf's parents? (I assume that is who he is living with).

    Income support, i would imagine is partly to pay for his rent.

    Dont think 17 year olds are eligible (18 year olds do as far as I know)
    make the most of it, we are only here for the weekend.
    and we will never, ever return.

    He's lodging there so a tennancy agreement wouldnt apply
    make the most of it, we are only here for the weekend.

    IS entitles someone to full LHA for their area if they have a tenancy agreement.

    I don't think you can be a party to a tenancy agreement if you are under 18.

    But, in this case he wouldn't have an entitlement to a tenancy anyway as he's a lodger and only has a licence to occupy part of the premises owned and lived in by the landlord. He can claim HB but he has to already be paying rent and not just starting to pay the rent because HB is paying it. Will he be made to move on if the rent isn't paid?

    There is no lower age limit to claiming HB.

    He has been paying from rent money from his income support, he can only stay if he pays and he would be asked to leave if wasn't.

  • You can claim HB if you are a lodger, one of our lodgers claimed it, I just wrote a letter saying he was lodging with us and how much rent he paid. I also gave him a rent book.

    So being a lodger won't stop him from claiming, although I'm not sure if you have to be 18.
