They might refer you to the VOA, but you should be paying the rate for the band you've been valued for. Once that is sorted out then you need to see which is the correct banding.

    My situation is briefly as follows:-

    My house is in Band "E". I live in Stratford upon Avon
    Through this webb site, I discovered that my neighbours house, which is idental to mine in every respect is in Band "D", and was reduced from Band "E" to Band "d" in April 1993.
    I also followed tis webb site to recalculate the value of my house in 1991, to discover that it should have been in Band "D"

    I approached Stratford District Council who could not help and redirected me to the valuation office in Birmigham. I was told by an assistant that because I had lived in the house for the past 25 years, I was given 6 months to appeal against the coucil tax banding from 1991 and that it was now too late.

    I have all of the council papers from 1991, and calculate that I have over paid council tax by over £4000.00 over the last 16 years.

    Can anyone advise on this.

    You might find it helpful to read some of the earlier postings on this thread as this is a common problem. While the 6 month rule stands the VOA are under obligation to keep their listings fair and accurate, so if you do your homework and compare your house with other simillar houses you may find the evidence stacks up and you can get yours changed. As you say your neighbour got theirs reduced this may well count in your favour. Its not technically an appeal (as I understand it, but I'm no expert!) but you can still ask for a revaluation. The result should hopefully be the same.

    I am in a simillar situation to you (ie. outside the six months) and am currently trying to 'persuade' the VOA to revalue the property.

    If you can find another property like yours which has been rebanded within the last six months you have an even stronger case.

  • Hiya live in a 2005 new build in Scotland and wondered if there are different rules for new builds. It seams that all houses in our area built in the last 15yrs are banded higher and on checking Martins links it looks like the house values have not been converted back to 1991 prices but are banded on their current valuation surely this can not be true.

    Also missed the 6 month appeal as we wrongly assumed that what we had been told by the Assessor was correct and had no reason to disagree.

    Does anyone know of any other HPI to use. I have looked at my home and using the provided keeps us in the same band by £400. However, I put int he details of my parents home which they bought in 78 and they have calculated the value now o be about half of what it actually is.

    I notice they lump all of Yorkshire and Humberside together. We live in Leeds and I suspect the price fluctuations are a little greater.

    Any help?

    This is our situation:

    We've been in our house since May 2001, when we paid £59,000 for it. We've been paying council tax band C.

    We've followed Martin's instructions to work out whether we'd be entitled to a rebanding, but have a couple of problems:
    1. The house wasn't built until 1992
    2. all similar houses on our street are also on Band C

    However, the house price calculator worked out that the value of our house in 1991 & 1992 would have been around £38,000 (Band A). This is based on using the last house price sale on our street which was £107,500 in July 2004.

    Our question is, would we have a possible claim for rebanding purely based on the above?

    Has anybody been in a similar position or could advise us?

  • sorry if this has been asked or answered before but with over 500 posts its a bit difficult to find. My question is this- i have moved house in the last 6 months and my new house is correctly banded but my previous house was apparently overbanded - does anyone know if i can claim back what i have been overpaying for the last 10 years.
