Eleanor did you check the banding against neighbours' houses and archived library 'for sale' pages or builders sale prices etc whilst you were occupying the house?
You have to have good evidence if you feel the banding was wrong.
What was the house banded at after the sale?
If you have sold the property you cannot appeal against the banding. Only at the time you lived there. (see some of the previous posts on this thread about this) There's loads of good information if you read through.
If the new occupiers appealed against the banding and were successful in getting it reduced you could claim for the time you were at the house.
The voa will probably reject your letter as you have sold the house.

I recently applied for a re-banding on behalf of my parents, and have had a letter from the valuations officer to say that they have now gone from a B to an A, with effect from April 1993.
I have worked out that they have overpaid by £1285.
How do I go about reclaiming this money for them, and are they entitled to interest on it?

bb999 If you read back on some of the posts you'll see that a few posters have managed to get interest on their rebate. It's not automatic though and you might have to put some work into getting it.
There's plenty of good advice further back on thread.
The rebate should come to you from the council.. Once voa advise them you should get a cheque . Make sure they pay back to 1993 as some councils are saying they don't have records back to then and don't pay the full amount! Some councils are also taking the full year's council tax 2007/2008 from the rebate. If your parents pay monthly tell council they want to continue that so they don't take a lump sum.

Hi can anyone tell me if it is possible to reclaim overpaid council tax after you have sold the house? we sold our house to our Daughter about six years ago and now we have found out that the banding was wrong, have we any claim.

Richard the short answer is No you cannot appeal for a rebanding if you have left the house. See my post 1342 above and there are many other posts on this thread explaining this.
However as you sold the house to your daughter if you get her to apply for a review (rebanding) and she is successful you can apply for your part of the rebate.
You and your daughter will have to find plenty of evidence ie 1991 house prices etc etc.

Hi. I'm no expert but I don't think your house being part rent/part buy will make any difference to the banding.
If it is incorrectly banded that is the issue.
Have you checked similar houses to see what band they are in? Is your neighbour's house identical to yours? You have to compare like with like.
You'll have to find 1991 prices for your house even if it wasn't built then as that's when voa banded properties. Don't forget also that prices went down after 1991. What does £97.500 equate to in 1991?
You cannot go on the calculator alone. Voa won't accept that. Look at archived library property pages for 1991 and find something similar to yours and the price then.
Your friend's 4 bed house may be in the wrong band? If it's in the same road and in middle of smaller houses it may have been an oversight and banded the same as the smaller ones?
Be careful about this as bands can go up too and your friend wouldn't like that!
Another poster has said his house was incorrectly banded as it was leasehold and the voa were not aware of that. Look back on the posts on this thread and the success thread and you will find loads of good information to help you.

thanks masie the one thing i dont know when tracking back the houses value to 1991 is do i find the value of the half of the house i baught or the house as a whole as i only own half the house it is rather enigmaticMerry Christmas MSE!0
