Gone missing **ib medical**

Here we go I am due to go for a medical for IB which they decided to tell me (by not paying my money into my account) 18th December.....yes almost a year later I get my appeal so those who are waiting.......dont hold your breath.
I was medically retired by DWP about 3 years ago rocking horse s*** is more common.
They gave me a medical before i applied for IB which I passed and was told by Dr. that i would not need another medical for minimum of 2 years.
The back end of last year i had a medical who said i was fighting fit and ready for work, To my surprise they cannot find the original medical details (seem to have somewhere in the back of my mind that ATOS didnt do the medicals) I have my appeal mid October my condition has worsened (my consultant says it wont improve)during the time waiting i have been recieving ESA but just failed that medical too,,,,,I am not pulling the wool i would like nothing better than to go back to work.
3 weeks ago i suffered a stroke thankfully not too much affected apart from my memory.
Do i tell the tribunal about my stroke as it happened "after the date in question"
Any help will be greatly appreciated.

    Had an Occy Health medical by Atos recently, basically been pulled off frontline duties due to pain meds, that have never affected me in any way, and also they said my back is knackered, etc,etc, then finished off by saying I may get better, but no time scale metioned, no treatment mentioned, no adjustments mentioned, didn't confirm coverage under DDA. An absolute waste of space, was funny watching the people chatting and walking about the waiting area then when their name was called having to be helped up from their chair and helped across the waiting room, when you see such blatant mickey taking I suppose it is likely that the staff would distrust everybody and not beleive what they are told, maybe they should just put cctv in the waiting room.

    As far as the stroke goes I would tell them, as they expect you to inform them of any improvement so surely they must want you to inform them of anything that has had a negative effect on your health.

    Having put in an appeal for ESA and gathered all of the evidence to prove that the ATOS report was wrong, I had to cancel it.
    Anyhow, having done all of that, I was told by the DWP & The Tribunal Service that anything that happened after the date the decision was made that you are fit for work does not count at the hearing. They are only there to see that the 'decision' was the right one based on the facts and evidence available at the time.
  • Had appeal today, was there for 20 minutes then was called back in to be told that i should not have had to appeal as it was obvious that i could not work.
    Wait to see how long it takes to pay me the money they owe me, not holding my breath.
    They totally ruined last christmas, they paying for it this year.
    What goes around comes around.

    Congratulations, i hope you dont have to wait too long for your money.
    Thats interesting they 'lost' details of your previous medical, pre Atos as they seemed to have 'lost' all of mine too!!

    They lost my earlier ones to, after I complained via my MP.

  • It's odd that previous medicals go missing (when real doctors did the job). As i have said in previous posts i used to work for DWP (for my sins) and i KNOW for a fact that paperwork doesn't just 'go missing' it is all stored in central filing and microfilm. They find stuff from years ago in my case going back to 1995 but not something done 2-3 years ago.
    Have you tried asking your GP if they got a copy (if you agreed to them contacting your GP a copy may have been sent to them.

    Hope not to wait too long for money been told it will be about 3 weeks, thats what i was expecting.

    and remember KEEP FIGHTING I waited almost a year and i know how stressful it can be but hang on the more people that win on appeal the less chance ATOS will get it back, so we might get sympathetic doctors who listen to you rather than put what they like.
