aol upload speeds????

ok IP is aol (CPW:() down speads are average 4302,31db line noise attenuiation so technically could have bigger down speeds with some tweaks if aol listened properly. upload speed is poor 412k with line attenuation up at 10db surely this is incorrect with line attenuation like that should have more like a meg plus?
ping is never under 50ms connected to test socket.
exchange is three miles away, bt engineer finds no faults internal external, line test with aol says my line is strong and good, but when asked why the low up speeds they say its down to the pc.
pc is windows 7 ultimate 64bit,8gb ram,500gb hdd, virus free and maintained and optimized. i have a belkin cat6E ethernet cable,and belkin modem cable (all electronic,magnetic interfearence resistant oxy free cables) bt man was impressed.
ping and upspeeds causes problems with games, and uploading photo's etc.
why wont AOL do anything with my line!! i mean cmon bt at capped peak times is better than this.
