in Credit cards
I got a letter today from Capital One - RE:notice of sums in arrears saying I have missed the last two payments to my capital one card.
Strange, I thought, as I cleared the card in May in my effort to become debt free. I phoned Capital One and got straight through to the collections team who insisted I make a payment there and then.
I explained to the member of staff that I cleared my debt in May and hadnt made any purchases on the card so how can there be any balance out standing? They then told me that in august they had charged me an annual service fee of £18! and the two subsequent missed payments now meant I owed £42!!! I asked where the statements were and they said I was on E-statements and I should have received them! I didnt receive any emails or telephone calls about this and am now gutted I have got 2 missed payments recorded on my credit history over £18.
To top it off I checked my credit card and it expired at the end of July - so they charged me an annual service fee on a service that I couldnt have actually used even if I had wanted to!
I eventually got through to a manager and after a 35min phone call managed to get all the charges dropped and my balance is now down to zero again.
Is there any way of forcing them to change my credit history? Can credit history be changed?
Any advice from anyone who has achieved this or knows anything about how I should tackle this greatly received.
Thanks

Ok. You will need to write to Cap 1 to ask them to reflect this information, it might take along time to get this sorted depends how bad cap1 are.
Do not call them as you need to have proof and if you need to go down the FSA route you will need proof.
Write a letter along the lines I have accepted the offer to refund my charges due to annual service fee and missed payment fess, as this is an admission of fault can you please reflect this on my credit file.
Did they send you a new credit card at all?I all have learnt is from others on many sites.
Seek legal help if unsure.
Dont pay Private Parking tickets - they are mere invoices.

thanks for the quick reply!
They have said they will send me a new card, not that I really want it but thought it might be a way to repair the damage that has been done to my file, I think I have to have 18months of no missed payments to get it back on track?
Do you think they can legally charge me the annual charge even though it would have been impossible for me to use the service?
I am quite pleased to get the charges dropped and as you say this can be interpreted as an admission of fault, do you think a threat to go to the FSA is enough to make them change my file? They said I could post my own"excuse" on my file which should suffice but a) it shouldnt have happend in the first place and b) why cant they reverse what they have done!
Thanks - time to write a letter now0 -
That depends what was the service...
Just holding the card? Were you aware there is annual fee to be charged?0 -
I had forgotten about the charge but they will argue I have paid it every year since 2001 so should have known to pay it this year - which I would have done had i got any statements....
I wish I had just cancelled the card now - I have had such a rubbish credit rating in the past with CCJ's and missed payments etc etc. I have worked so hard to sort it all out and now got to wait to clear this damage - will it be frowned upon if I were to apply for other credit cards?
I think I will go down the route of a letter an hope that their gesture of clearing the debt is seen as an admission of fault and therefore reverse the damage.0 -
Hope you get it removed but you'll be lucky I would think.
Good luck."We want the finest wines available to humanity, we want them here, and we want them now!"0 -
I thought they got rid of the fees in about 2008?0

as you might be aware. Dont close this account if they have put on your credit file the missed payments. But I think you know all about that.
HSBC did the same to me a few years ago. Then they defaulted it for good measure.0 -

I had it in 2002 with the classic, then around 2008 they sent me a letter saying it was no longer been applied0
