If you have problems with a loss adjuster and the insurer says it is out of their hands tell them that the FSA and Financial Ombudsman Service are quite clear that anybody an insurer appoints is acting as their agent and the insurer must therefore respond to it.
Remind them that under the FSA rules you can make the complaint verbally, they have a maximum of eight weeks to respond to it and the time has just started!0 -
Thanks, the insurers are KwikFit, and the insurance was arranged through a broker who recommended KwikFit and in fairness I have had a kwikfit motor policy in the past, but never had to claim, so will find out Monday, I have drawn up a list, room by room of defects caused by the water, I just want it putting back to it's original state, nothing more, but as quickly as possible because three weeks have now passed and it is so depressing looking at what it is now, compared to how it was0

We have had a on going claim with merlin loss adjusters since november 2005 and we had to involve the ombudsman in 2010 because the work was done in 2008 to try and resolve the on going problem but the problem came back,i was telephoning merlin everyweek for nearly a year but a certain loss adjuster who is still dealing with our problem would not reply to us.the ombudsman did a full report of all the damage to our property and asked why it had not been properly investigated in the first place and no work should have been done because it was wasting the insurance companies money all the work has to be done again, the estimates have been sent to merlin and yet again i am on the telephone nearly every day arguing with the loss adjuster, now its about how much it is going to cost, i have already spoken direct to the insurance company and they have held their hands up and said it was their fault and told merlin that the work has got to be done, but am still waiting, merlin is the worse company i have had to deal with, but am not giving up.0

One of the problems is that some insurers are told they have to use specific companies for loss adjusting claims............now if my insurance claims negotiator brains serves me correctly loss adjusters are normally appointed where there are large claims ie fire/flood
or if there is an element of potential fraud involved or claims which are likely to exceed £5000 in costs..........
I have never dealt with Merlin but the loss adjuster should be keeping you regularly updated and if there are any issues they should be fully forthcoming with any information or questions in order to progress the claim..........saying that I have dealt with some that are insistant on passing the buck...........speak to a manager..........keep a record of all correspondence between you, the insurer and the loss adjuster and get the insurer to kick the loss adjusters !!!! if you have to...........that is what you are paying them for............
