Evans Card/Santander claim help please

Options
Hi, hope someone can advise. I had an Evans Card from about 1998, originally backed by GE. About 12 months ago, they sold the business to Santander, who subsequently sold it to a Debt management company. I have now paid off the card in full, and I seem to remember that I cancelled the PPI about 3 years ago. Who should I send the initial letter to? Ge or Santander? I have a Debenhams card with the same question, as well as a Goldfish that is now Santander I think also. many thanks indeed

    Hi there

I would still send to the ones who set up and sold you the policy and they will forward on to the relevant complaints dept to whoever they are with now, post by recorded for delivery, so you can check the status of the posting.;)

Thanks Di, but can you advise the process I should follow on this. Do I send the questionnaire off with the letter asking for the loan agreement together, or do I need to have the loan agreement first? thanks

    Hi there

To request for the agreement, just write a separate letter to that of the reclaiming questionnaire, and request for a copy of your agreement acc number XXXXXXX, and enclose £1 cheque or postal order, ask they supply by 12-14 days of your letter.

As long as you have the account number details you can continue to make a reclaim, you do not have to wait for the loan agreement.;)

Hi, I have now received a letter back from Santander regarding my Debenhams account. I hadn't realised or remembered, but it was actually set up over the phone a few months after I opened the account. Their argument is that it was adequately explained to me and as I did not take advantage of their 30 day refund policy, I must have been happy with it. I had thought the lady in the shop filled in the form for me, so I was wrong there.

They are still charging the PPI and say that as the premiums are clearly marked, I must be happy with the product. They have now cancelled the policy on 2nd Nov. They also say that the policy was "upgraded" twice and I would have had the revised terms, but I don't recollect anything like that.

Is there anythjing I can do with this now? Many thanks

    Hiya

You could request for the copy of the telephone calls, write and explain you were informed it was explained to you over the phone, and you would like them to provide the evidence for this, by via recording disc or a written transcript.

However, it may be the case that you would have to request a SAR for this - where they send all the data they hold on your account going back the last 6 years, but you enclose the payment of £10 cheque or postal order, they have 40 calendar days to comply.
    SAR template letter here:

This may be of some help, if they provide the evidence, so you can see or listen for yourself.;)

Thanks Di, but the call was made in 1998, would they still have a record of it? They were able to give me the date they called, allegedly.
