  • I think you'll be fine once your son's true condition is established. My son (Aspergers) never see's the GP unless he has a cold and I always write this on my claim form although I give them permission to speak with the GP too.

    In my recent claim they didn't even bother to contact my named contact (special school), and picked and chose evidence to suit themselves and turn me down, went to Tribunal and won. You just hold in there, Welfare Rights know their stuff and I'm sure it will be alright soon.

  • Thanks wornoutmumoftwo I hope your right ,he also has a condition which is part of the autistic spectrum
    but I don't think this was even mentioned by the gp.We only see the specialist once a year for this as
    we know that if we stick to routine he'll be ok.
    The reallt annoying thing is that we had it awarded in August,then the GP finally replied to their letter last week
    (from July!) and we had it whipped away,not even a lower rate....I have really lost faith in my GP now..

    are you keeping a diary which states what needs your son has? At the age of 14, he may be expected to do some care related things for himself.

    You have 4 weeks from the date of the decision to appeal it so if you set the wheels in motion in the next 4 weeks it will take months to get through everything anyway, so don't worry about the NHS admin being slow, they won't do anything without all the relevant information from everyone in the first place.

    It's 6 weeks if you apply for a statement of reasons. (SoR)

    Looks almost as if they acted on the GP's letter without referring back to the information you had previously supplied and which was sufficient to get the DLA awarded.......

    You can't ask for a review and then appeal. if you go straight to appeal, they review it as part of the appeals process.

    Notify the DLA immediately in writing that you wish to appeal and the full reasons together with supporting evidence will be forwarded once you have had the opportunity to seek further advice. This will keep you within the time limit and hold the situation.

    Send the letter by special delivery - it costs £4 but is well worth it - when we sent off the forms for my DGD's renewal, my Dil was told that they hadn't arrived and she was outside the time for applying - we were able to quote the RM website with the date and time the papers were received and who had signed for them - they found the papers the same day.

    Then get make appointments to see the consultant, physio, cystic nurse, and any other professional involved in his care, explain what has happened and ask them for reports - get the reports sent to you, so you can forward them together.

    It is also useful to get a report from the school stating what help he needs, how it affects his education and development and so on.

    Obviously speak to the welfare benefits adviser before getting the reports to see what she has to say, but make the appointments anyway, as this will take time.
