Underlying Entitlement

"When you apply for JSA, you are assessed for both contribution based and income based. If you have paid enough contributions, you are actually 'entitled' to both, but only actually receive contribution based, because that over-rules income based. But you still have an underlying entitlement to income based at a rate of £0.00 a week. And its the 'entitlement' that matters, rather than what is paid. (At least I think thats how it works !!!)"

I applied for JSA (IB) because like many I thought you needed to be on an income based allowance to get help with your mortgage. So I completed the forms and sent them off, within the week I received a letter saying I was not entitled to JSA (IB) because of my wife's earnings.

Then about 3 weeks later I recieved a letter from the manager at the DWP asking me to completed a MI12 form and send it too my lender for help with mortgage interest payments. This was done and my lender is now sending it back to the DWP. Then a week after receiving that letter I received another from somebody different saying because my claim for JSA(IB) was declined I could not claim for mortgage help.

Are they trying to hoodwink me here because from the quote from Victoriajayne I think I qualified under 'underlying entitlement'. I have been paying NI contributions since I was 16 and I am now 43 have I paid enough for both, or is it not a lot of DWP staff know about 'underlying entitlement' and so refuse any help with mortgage interest. Any help would be appreciated.

    Your wife works thirty hours per week. Therefore you are not entitled to IB JSA.
    Gone ... or have I?

    As dmg24 said, if your wife works more than 24hrs a week then you do not have an unlying entitlement to JSA (IB).
    JSA IB entitlement is also dependent on your household income and savings.
