Halifax PPI advice please

Hi everyone,

I'm after some advice on whether or not its worth pursuing a PPI claim.

I got my Halifax CC in Sept 06 and duly signed the credit agreement and returned it.

I done my application online and after looking into PPI reclaiming, thought that it may have been a "pre-ticked box" scenario, so I made a DSAR to the Halifax.

They've sent me back page 3 of 12 where I've signed and then signed again to agree to credit card protection, however, page 5 of the agreement relates solely to credit card protection and has a box for you to sign. I still have this original unsigned copy.

I've called the Halifax this morning and asked them for all 12 pages of the agreement, as I couldn't remember if there had been 2 copies, ( 1 sign and return 1 to keep ), and when I explained that there was an unsigned section it was met with "Oh". The woman I spoke to said they, ( DSAR section ), get their information from another department and she'd contact them to forward all pages on.

I'm not sure now if I've been mis-sold or not, as I have quite clearly signed and ticked the box for one part of the agreement, but not another. Another question would be does the PPI "stand" as I haven't signed all parts of the agreement ?

Anyone with any advice, ( other than "you're a dumbass for having it in the first place"! :o ), would be much appreciated as I'm starting to confuse myself here !!!!!!!!

    If I cancel the PPI can I still pursue it or does it "not count as you've cancelled"

  • If you were sold the card on a non-advised basis they are much more likely to decline your complaint. I would state to them at the time you rang up and spoke to someone and then the onus is on them to prove that you did not receive advice. Make sure you include a complaint issue like

    "The advisor did not tell me about the common exclusions for the cover"

    and some of the other complaint issues as listed in Martin's article.

    You can still complain about a cancelled policy so don't worry about that at all.

    The customer copy of any agreement is rarely signed, especially if it was the type that you sign at home then send in to the company.

    Thanks for the advice. I guess it won't hurt to give it a go.

    @melorablack - I was only sent one copy of the agreement. They required me to return page 3 of 12, I know I'd sent it in because I dug out the other 11 pages and that's when I noticed page 5 was unsigned - which related to the PPI.

    Right ok, the other scenario is that you may have been sold the PPI when you called to activate the card in which case nothing needs to be signed.

    Definately give it a go, you've got nothing to lose.
