CCA question & advice needed..
My dad bought a van from vauxhall & is under finance with blackhorse.
Over the past 2 months it had developed faults and has been taken to the garage again. 1st time it had an injector fault, 2nd time another injector fault, 3rd time it's using far too much fuel and the oil is being used very quickly.....
Does he have any right to have the finace cancelled & return the vehicle as it is "not fit for purpose" ?
From what i have read on the internet the finace company is in breach of contract? is this true ?
Any help/advice greatly appreciated !

yes there is a warranty but ideally he would like to use these problems to get the finance cancelled & return the vehicle if possible0

How old is the van and how long has he had it? How many miles did it have when he bought and how many has it covered now?0

Is the van new or used, how old, how many miles etc...?
To use "too much fuel" - how has this been recorded? (Bearing in mind hes had it 2 months)
The oil consumption is a problem though and needs sorting. But unless you give the selling garae time to fix the faults then there is nothing else that can be done.0 -
the van is a 2008 Movano - has covered 28,000 miles - it was bought form vauxhall with 8000 miles on the clock & has been serviced by vauxhall at the required intervals - the van has been owned for about 18 months
It was giving an average of a tank a week with the set mileage - now a full tank only lasts about 5 days..
I am thinking they are in breach of contract due to the "goods not fit for purpose"
If it is going to use about 3 pints of oil in a month and drink diesel like there's no tomorrow then from what i can gather it's not fit for purpose..0 -
Give the garage chance to fix any fauls.
What is the mileage that is got from a full tank, as you havent said...0 -

You can put pressure on the finance compnay to talk to the dealer to sort the problem, but 18 months is probably too long to reject it.
When you get to a certain point in the contract you can surrender the van voluntarily, can't remember the percentage, though it may just be better to trade it in, as long as you have kept to the aggreement you shouldn't have a problem with refinancing, the finance company would be happy to no longer have an interest in a van with issues.
You may have problems proving not fit for purpose, but the agreement is with the supplying dealer not the finance company.
It would also be up to you to prove that 3 pints of oil over more than a thousand miles isn't unreasonable, some VW engines have used that much and VW said it was within acceptable limits, not saying I agree but that is the way they would see it.
I take it that it is fitted with a Renault engine of some description?
You could always push for a new engine under warranty, that is what i would do.0
