Student loans and bank charges incurred

The halifax bank of scotland (thieves and rogues) have levied a total of £129.30 bank charges on my account due to the student loans company instigating a direct debit for repayments of loans which shouldnt be paid becasue then loan is deferred becasue of earnings below the repayment threshhold.

The Halifax bank account in question has not been used for over 6 years so there was nothing in the account. Student loans took out an amount that put the account in the red and therefore also an unauthorised overdraft situation.When i contacted student loans about this issue they said they would repay the account. Until the account is paid Halifax charge £1.00 per day plus a monthly fee. Student loans did pay the account back but paid the wrong amount so the account was still in the red. I explained the situation to the Halifax stressing I had not used the account for over 6 years and therefore obviously did not need an overdraft.

The problem i had was i had no control over when the amount would be paid by student loans other than to pay the money back out of my own pocket until student loans paid up. The Halifax were totally stubborn and insisted the charges were legal and correct even though 1 they knew i had not used the account in 6 years. 2 They knew student loand had incorrectly instigated the direct debit. 3. They knew student loans had paid the wrong amount back.

In the end i have had to pay them 109.30 plus another 20.00 earlier on in order to prevent any further charges.

Should i take this up with the financial ombudsman. Apart from the so called legality of the charges the biggest issue here is the exorbitant charges they levy plus their lack of common sense in dealing withthe issue at hand. is this how they intend to clawe back the massive losses made by their incompetent merchant bankers etc and all the time whilst the taxpayer has bailed them out. it is a totally disgusting and particularly immoral state of affairs.

    Sounds to me that your argument isn't with the Bank but with the Student Loans people.

    Claim under the direct debit guarantee they "should" refund everything including the charges and reclaim the total from the student loan company. If they don't, go through their complaints process then sort your account out so it cant happen again.
