Hi everyone,

Am looking for some advice on an outstanding credit card payment from 4 years ago!:mad::mad::mad:

6 weeks ago I received a minimal letter from someone asking if I used to live at an address 6 years ago.I thought it was someone trying to pinch my identity, so I called the number and they were a debt collection "trace" agency and demanded a payment of £98.00 over the phone! I flatly refused as I had no idea who they were as the letter didnt say anything about the company!!Thought it was a scam trick!

I asked them to provide evidence, and it has taken them 8 weeks to send me an old Capital One statement. I was under the impression I had cancelled this card in 2004! Looking through the statement I had paid the card in full in April 2004 and there is nothing else on the statement until July 2007 where they have charged me an ANNUAL FEE of £18.00!!! No other Annual fees for 05 and 06???? Wierd!!!

Since I havent lived at the address where the card was registered for 6 years and havent used or been in possesion of any Capital One credit card since 2004, they now tell me I owe £97.39!!!!! The original credit limit was only £200.00 in the first place! Anyone know where I stand with this? Thinking of going to the Ombudsman!

    If you last made a payment in July 2004, then legally there is nothing they can do to make you pay. After 6 years it becomes "statute barred" they are breaking the law by even chasing you for it. Do not talk to them on the phone.

    Might be a good idea to order a copy of your credit file and see if there is any black marks from capital one against your name for non payment, if there isn't, tell them to get stuffed.

    if they keep pestering you, search on here for a statute barred letter, or an unenforceable template.

    send them that and it should get them off your backs.

    I would get your credit report from Experian & Equifax.
    Personally I'd recommend paying £2 for the statutory reports rather than the free trials or more expensive ones.

    Come back and let us know what they both say about that account.

  • Hiya and thanks for you're reply!

    I spoke to the debt collecting agency with a few choice words and basically they have said they are not going to persue me and will hand it back over to Capital One! Hopefully wont hear anything more about it! Anyway if they persue me again, I am going to report the debt collecting agency to the office of fair trading for the way in which they got me to contact them falsely and underhandedly!
