!!Steer clear of CARCRAFT & Creation Finance!!
Hello, 1st time poster
I had to post my advice just in case anyone else is as uninformed as I was.... Don't repeat DON'T get a car from Carcraft or a loan from Creation Credit like I did. My boyfriend needed a car and I tagged along with him to Carcraft to look. He saw one he liked, but couldn't get credit. The salesman said 'why doesn't your girlfriend apply for the credit, after the first payment is made you can transfer the credit agreement to your boyfriend's name'. I asked if he was sure as I'd never heard of this. The salesman said couples did it all the time, and being naive and not wanting to disappoint my boyfriend I agreed. I applied and got credit from Creation Credit.
I rang the credit company the next day to check what the salesman said was the truth, and of course they said that wasn't possible, it would have to stay in my name. I wasn't willing to carry this credit for four years as you don't know what the future holds, my partner & I could split and he'd have the car in his name & I'd be left paying the loan. So knowing the agreement wasn't yet finalised & after getting advice from Trading Standards I told Creation I wanted to withdraw & give the car back, which I was entitled to do under the Consumer Credit Act. They practically laughed at me and told me they "don't do withdrawals". I phoned repeatedly, taped conversations with them, sent them a recorded letter, all *before* the agreement was finalised four days after going to Carcraft. They still activated the agreement against my will.
My case is being looked at by an adjudicator at the FOS now, and hopefully they'll rule in my favour. Meanwhile Creation Credit are bombarding me with threatening letters and phone calls demanding I start paying for this loan. This is one harsh lesson in consumer finance I won't forget.
Has anyone fought either of these companies and won?

There is no cooling off period if you signed in Carshafts premises.
Preaching to the converted on MSE, there are horror stories all over the place.
Wait until you GET the car and the bigger problems start (or you realise just how much this car is going to cost you)0 -

Carshaft lolI may have been naive but I know there's never a cooling off period when signing on premises. That's the one thing I *was* aware of.
As the agreement wasn't yet finalised, I had every right to withdraw, cooling off period or not. That's what four different Trading Standards advisers told me anyway.
I just wish I'd visited these forums beforehand...0 -
What's your boyfriend saying about it all? ducking and diving I expect.. lol lol
sorry.. hope you get it all sorted out honey..0 -

He feels awful! He's saving up for a car now instead, we're both avoiding credit agreements if we can help it now. I shouldn't have believed the Carshaft man anyway.0 -
Good luck to you but why is it not finalised?0

Yes the bit you haven't explained it what you mean by "not yet finalised".
Surely you either signed on the dotted line or you didn't?0 -
Carcrafty are expert shysters, I'n sorry but you'll probably have a hard job getting out of this one :-("We want the finest wines available to humanity, we want them here, and we want them now!"0

I'd signed on the dotted line in store yes, but Creation Finance hadn't. To finalise the agreement both applicant *and* creditor need to sign. Creation Finance is based in Belfast and Carcraft posted my paperwork from mainland UK. For the few days it was in the post the agreement wasn't yet finalised, Creation confirmed this themselves. It was the one loophole that gave me a chance of getting out of this mess.0

Hi Alarox,
I'm also new to this today but i felt that I had to reply to your thread as i'm currently experiencing the same issues with creation and carcraft. I'm hoping that someone will be able to offer me some advice or at least point me in the write direction.
Basically I had the same issue, I wanted a new car but couldn't get credit (another bug bear!!). So the salesman (and I fear that it is the same one) said "put the finance in your mom's name" stupidly we did and now a year down the line I have a car and finance that is also stupidly expensive!!
What I'm trying to get advice on is how the finance has been set up. I have recently found out that the agreement is a 'credit sale' not a HP agreement as I once thought. After reading around and speaking to the finanace company I've found that the car is legally mine thus meaning that I can sell it if i wish. Brilliant!! :j However, after doing a HPI check on my car, it shows there is outstanding finance (even though it's my car). Again I questioned this as was told that this will be removed if I inform them that the car has been sold. Great!! However, today I have spoken to Creation requesting that this is sent in writing and I was informed that if I was to sell the car I would have to use the money to pay off the settlement figure before they remove the HPI information.
Is this legally right? I'm so confused at the moment and no-one seems to know what Credit Sales are.
Any help would be brilliant.. Apologies for the long post :embarasse0
