Letting Agents took too much Money

My letting agents have taken too much rent out of my account, which means that I have gone into an unautherised overdraft, so now I am going to get charged by the bank.

WHat I am wondering is if i can get the letting agents to pay me back the charges that they have caused because of their mistake?

  • If they've taken more money than they are contracted to take then yes I'm sure you can get the money back from them for the charges that they have caused. They may well try and fight it though.

    I agree with firstaspect.

    However allowing a letting agent to take money from your account is a mistake. I asume you signed a direct debit mandate which allows them to draw variable amounts from your bank? If so, the DD guarantee applies too, so go and talk to your bank.

    Cancel the direct debit mandate and take control of your own finances. Set up a standing order instead - this is a fixed amount which YOU control which is sent to the agent each month. Or pay by cheque, internet transfer etc. That way you control how much you pay.

    Direct Debit Guarantee is your friend here. Phone your bank immediately. This will 'undo' the whole series of events.

    Next, stop paying them by DD and set up a Standing Order instead. That way YOU control the amount not them!

    Your bank can then organise to pay the funds directly to your account, however, should the LA advise your bank that it's not their fault and that the funds were legitimately requested, your bank will take the payment straight back. The bank will attempt to claw back the funds on your behalf, normally for 21 days.

    I would suggest you contact your LA first to determine why the extra amount was taken and if indeed this was in error. Then contact your bank, you're normally asked who's fault it is and it's a good idea to be in the know as to who the fault actually lies with in the first place.
