Car insurace admitted liability without telling me???

Can anyone tell me where I satnad in this bizzare instance...

My insurance company after months.. about 8 of going back and forth rang me the other day and said theyhad admitted liability and im not fekin happy as my 13k car was written off and it wasnt my fault..

They cant re-open it they said but I want it removed from my record as im not responsible and its there fault i now have a fault claim which I was willing to goto court for.

    so if (presumably for cost purposes) that they want to write off your case then it should be them who take responsibility (and liability)

    you should have a "no fault claim" against your policy - thus keeping your no claims discount, but that's it.

    Unless of course the OP is wrong in their claim that it wasn't their fault.

    Its down as my fault. So I can tell them its now the insurance companys claim and not mine as they admitted liability not me?

    Under common law your insurance company has the right to handle the claim as they see fit. This is normally backed up by a term in your policybook stating that they can do this.

    Most insurers will discuss the matter with you before taking a decision however they are under no obligation to do this.

    Without knowing both your version of events and what the other party has claimed to have happened it is not possible to give any view on their decision.

    If you really disagree, as opposed to simply not liking the decision, ask your insurer to state the grounds upon which they have accepted liability. It will probably be best to ask for a written statement (someone explaining it on the phone is a pain). Such decision are rarely wrong, though we may not like them.

  • They said because its took soo long and because the other 2 drivers also said it was my fault they had no option..

    Problem with that is I did crash into the other 2 drives but only because the idiot in the transit van span me out on the roundabout.

    I dont know what happened to you, but my insurance company accepted a witness's word over mine even though his written account of what happened was materially incorrect - he stated that I had hit someone else's car when in fact they drove into me, and the damage to the cars proved this. still, he said it was my fault and they believed him not me. Ho hum!

    Crsnewby, ISTM that for whatever reason you admitted this important info from your OP. I do nor know what the insurance experts on MSE would say, but I feel it is much the same as a venicle being backended and in turn hitting a vehicle in front. The front vehicle will cliam on middle vehicle, the middle on rear for damage to hsi car and the front one he damaged. Therefore ISTM that your insurer is right. What about the transit and a claim on hid insuer?
