Just received a PCN - advice please

My father today received a PCN for parking beyond the bay markings.

He believes he was parked on the line rather than beyond it and he has already registered an appeal via email.

We do not have any photographic evidence of how the car was parked as he did not think to take a photo until after the car was moved.

I have advised him to request photographic evidence of the offence from South Staffordshire Council.

Can anyone offer any advice.

Thanks

Head over to pepioo and post on there they are really good with council tickets
I all have learnt is from others on many sites.
    Seek legal help if unsure.
Dont pay Private Parking tickets - they are mere invoices.

    PRESS THANKS

  • Whilst you are at it ask for the PPO(parking place order) for that car park, unless that specifies that parking over the lines is an offence liable to a fine then the one given is invalid. Pic/scan both sides of the pcn (remove personal bits, but leave time and date)and host on tinypic. Copy the url for forums and paste into a post and remove the http:// bit.

I expect pepipoo will have already pointed this out - as it is often used for appeals on that forum - but FWIW for this forum, think the wording on the back:

    http://www.tinypic.com/view.php?pic=a47xv5&s=7

fails to include all the info required under regs 3 (2) (a) and (b) as shown in this ticketfighter link:

    http://www.ticketfighter.co.uk/ticket.htm

And I always say that personally I would appeal as far as the adjudicator, ANY Council PCN I get from now on (not that I collect them!). You really only risk having to pay the fuill fine amount if you lose (no costs) and in most cases the Council mucks up the process and/or paperwork in some way so that most cases put to an adjudicator win.

Also most cases helped by pepipoo posters win or the Council fold before adjudication.

So your chances are good but do take pepipoo advice on the letters you draft and remember that the Council will almost certainly reject your first appeal. It's a game of bluff to them - you just have to out-bluff them and keep appealing if you are so minded.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

We received a response from the council. The appeal was rejected.

My father then rang up the number of the letter and after some discussion they have agreed to cancel the ticket.

Thanks for coming back to tell us the outcome and well done, could you tell us what your father said, it might be helpful for other people in the same position.
Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!
Do you really need to ask what kind of people run parking companies?

Basically pointed it used to be a space and that the lines hadn't been completely removed.

This again points up the difference between council parking tickets and those issued by private parking companies. With the former, if you have a strong case, there is every possibility that you will win your appeal. With PPCs all you will get, in 99.9% of the so called "appeals", is a flat rejection and the threat of court action.
