Renting off x partner

I have currently split up with my partner and we have a kid together. The mortgage on the property we live in is in my partner's name as he bought it before we got together. Now that we have split up we are in abit of a situation as he needs somewhere to live and so do I. He is currently letting me live in the house and he is in his mums, all are kids friends etc are around were we lived. He has been to the bank and they will be able to give him a bigger mortgage if he has abit more income, Someone has suggested i could stay here and rent this off him and he could them afford somewhere to live so we are both happy. I would be working 16 hrs a week and seeing if I could claim housing bennefit for a top up. Is this allowed to do lawfully or is it not allowed.

You cannot claim LHA (formerly housing benefit) if the landlord is the parent of a child living in the property.

The other house is now sold and the money from it is back is a personal injury trust now for private treatment which it was originally for. I have one other property where me and my x partner and child lived but have now split up. I am moving out the house as we are not together and it will not be me who would be claiming lha it would be my x partner but she would also be working part time. All I wanted to know was if she could claim on the house where the child and herself is living and the landlord is the dad of the child i.e me. If this did not happen house would have to be sold anyway so was looking for a alternative and better solution. My x partner could keep the house and would not have to move.
