BPA Adjudication Pilot

Came across the following website which appears to be part of the BPA's latest attempt to give PPC invoices a figleaf of legitimacy by running an "adjudication pilot":

Some of the stuff on here is priceless. "The car parking company which took enforcement action against your vehicle has decided that, in their view, the action taken by them was correct." You don't say. Have they also decided on the Catholic religious affiliations of the Pope and the hygienic woodland habits of bears?

Or more seriously: "As you may know, because there is no formal regulation of parking on private land, you have no further redress other than to take formal court proceedings. "

Err no, wait up, I think that may be the other way around. Of course what he meant to say is that the car parking company has no further redress other than to take formal court proceedings. I mean how hard can it be to get this right?

    And no mention that they have to go after the driver and not the RK. There is no way of the PPC easily finding out the identity of the former.

    PS. Correction. If you read this:-

    They have to go after the car and not the driver or the RK

    I don't know why the BPA are going ahead with that "independent appeal" nonsense when Patrick Troy, the chairman of the BPA, admitted in front of a House of Commons Committee that private parking tickets are virtually unenforceable.

"

    There's already one, it's called the Small Claims Court. If PPCs have a case they are welcome to use it.

    The only loss is to the landowner surely, they don't own the land, so how can there be any loss to the PPC ? And its not legal for them to issue penalties to people and their tickets are clearly that!
    Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
    They are all or have been suspended from accessing the DVLA database for gross misconduct!
    Do you really need to ask what kind of people run parking companies?

    I don't even see the need for an independent appeals panel. There is already plenty of case law in place, and a perfectly good system for the PPCs to pursue the "debts" if they so wish.

    Is this just wishful thinking by the BPA?:-

    This pilot is designed to test the principles behind formalising such a service and may form the basis of a statutory appeals service when the Government legislates to introduce one.

    Are they actually hoping that the government will pass a law about this?

    BPA want to overthrow 100+ years of contract law by legitimising 'tickets'.

    Independent appeal? Red herring.
