resigning tenancy vs statutory monthly

Hi, so my tenancy is up for renewal in a couple of months, we have had a letter from the agency asking if we would like to carry on, sign a new 6 months or go onto the monthly periodic one....

if we go on to the monthly one can the landlord decide they are not happy with this and turf us out because they want the security of a tenancy agreement?

  • Yes, they can. If you want the comfort of knowing that you'll have security of tenure for a defined period then sign another AST. If not, go onto a period tenancy but you will have to give a month's notice and your landlord will have to give you two. If you look after the property properly and always pay your rent on time I can't think of a good reason why your landlord would not want you there long-term. Landlords hate void periods when there is no rent coming in.
  • With notice, yes. Although you could also leave with a month's notice.

    I am a landlord in one town and a tenant in another and have happily used monthly agreements on both sides.

    Unless you're a bad tenant the landlord would be mad to chuck you out for an unknown void period then an unknown tenant who may leave after six months anyway.

    However, if you know you want to be there for at least six months or have reason to believe the LL is unpredictable (or mad!) you might want to sign for another six months but do check what the agency will charge you for this.

    Many LLs and Ts continue on a stat perioidic agreement (SPA) for several years after expiry of the original FT. If you have hitherto been a reliable T a LL is not going to want to kick you out just because you'd prefer a SPA to arise.

    How lucky you are to have an LA who actually seems aware of the existence of stat periodics :wink:

    If you do go new FT yes watch for those renewals fees. There are some LAs who will try to charge for a Stat Periodic and/or ask you to sign some form of document ( entirely unnecessary, as SPA simply arises under law when LL has not sought court order for repossession and T remains in occupation after FT expiry)
