elp with Ebay

can anyone help.... I sold a car last month on ebay for £400.00 sale went through ok but the buyers credit card was dogy, ebay canot get the money off the buyer, who says he did not recieve car, the police asure me he hase registered th car in his name, E bay now want the money back from me but because i was on holiday I never got messages from ebay untill they closed the case and now demand the money .......WAHT CAN I DO

    How did they pay. I hope it wasn't by paypal . Motors is the only place on ebay you don't have to accept paypal.

    If it was your a bit !!!!!!ed as the only way to protect yourself is to show online proof of delivery (as in Paypals Seller protection policy). And to protect from fraudelant use of credit card you need proof of posting to show it was sent and the policy would cover you.

    If he did pay via paypal and the above is the case paypal will persue you for the money. Your only option would be to take the buyer to the small claims court and even that wouldn't guarantee the money.
  • Yes your only hope might be the small claims court. Do you still have copies of the vehicle documentation? I presume theres a DVLA document you have to fill in to transfer the ownership? Did you keep a copy of this?

    If so you probably stand a good chance in court.

    Am I missing something? He's telling eBay that he hasn't received the car. The police have confirmed that he's registered the car in his name. Have you told eBay this??

    Report the issue to the police.
    This will now be in the form of a stolen car
    It is easy to get the buyers name and address from DVLA but they may have sold it on again and its the new owners that are registering it.

    If you get the police involved then you may be able to stop paypal reclaiming the money from you but not sure??

    In fact if you tell the police that is has been bought by fraudulate methods and that it is now stolen, you should at least get your car back from who ever has it.

    Might be better asking on the Ebay part of the forum

    It sounds a though you accepted a Paypal payment and according to there rigid rules you would need to show proof of despatch of the item to the correct address to protect yourself. This would not be possible with a car and is why it is the one catagory where you are not forced to accept Paypal payments.

    As has been said, I think small claims court is the only way forward

    I have proof of sale but Rbay are sayinging because i never got back to them whithin 3 days the mater is closed as far as they are concered and they are demanding the money from me

    But if the payment was through paypal you would need to provide a certificate of postage or equivalent to show that the item was despatched to the correct address.

    I think you would be better off asking on the Ebay forum but you need to confirm that it is Paypal asking for the money

    If he's saying he hasn't received the car, but someone has taken it from you, then quite clearly it's been stolen. You need to report the theft to the police.
