Asda 25% off Jeans offer!!

My boyfriend bought a pair of jeans last week from asda. They were £10 but had 25% off due to them running an offer that stated 'while stocks last'. As it was at night and him being a man, he didn't try them on but bought the same size that he had bought from the same range about 3 months ago. When we got them home, they were extremely tight! We have taken them back tonight to exchange them for a bigger size, however he has had to pay the extra 25% because the offer is no longer on. Is this right?? They are the same jeans, we hadn't even had them a week and if it was the other way around you could bet that asda wouldn't of given him £2.50 back! I know its not a lot of money but the offer was something that made him think of buying the jeans in the first place and we feel a little bit peeved about it. I wanted to find out if this is correct procedure before contacting asda, the lady at the cs was very helpful and apologised repeated. Thanks in advance for any responces!!

  • ASDA are in the right.

    They legally don't have to offer you anything as the jeans themselves are not defective - they just don't fit your partner. Any opportunity to return or exchange the items is purely a gesture of goodwill on their part.

    Take them back again and askfor the general manager, the CS girls have no power to bend the rules.

    On the Tuesday before the Asda off 25% jeans sale I bought a pair at £10.
    On the Thursday, when I went to do the weekly shop, as soon as I entered Asda, there were notices about the jeans sale.
    Having not worn the jeans, I took them back and got a refund of £10.
    I then picked up the same pair of jeans and paid for them at the checkout, £7-50.

    So it does look like Asda was correct in the OP case.
    If he had said I don`t want an exchange but my money back he would have received his original £7-50.
    He could then have bought another pair but not for 25% off because the offer had ended.

If the jeans were faulty would i still have had to pay the extra £2.50? Just wondering for the future!!

    There`s nothing more annoying than paying more than you have to.
    I felt exactly the same as you but luckily I was in a position to do something about it.

    not sure what the point of buying a pair for £10 and returning other pair as you will still have paid £10. You may have well just paid the extra £2.50. would be quicker.

    If the jeans were faulty, i guess legally they only have to give £7.50. If they were out of stock or line discontinued you would not be able to swap it anyway so i doubt legally you can force them to do this.
    If you bought the jeans for £10 and took back on the day of the sale I would expect them to give you £2.50 if you swaped the jeans for a different size.

    As they were the same jeans I would of taken the orginal jeans that were too small back with the receipt for £10 (from the bigger sized jeans) therefore getting the jeans I that fitted for £7.50.
    Its annoying more than anything, due to the fact that the correct size was bought in the first place, well the same size that he had from there about 2months ago in a different colour. Sizes are rubbish these days, taught me to try everything on, even if I own the same thing in a different colour especially if they are running an offer. I loved the wording of the offer 'while stocks last' isn't really worth writing because it could mean so many things.
