tree on private property overhanging communal parking

we have a small area of communal parking for 6 or 7 cars in our cul-de-sac and a tree from one of the houses that backs onto it overhangs loads, and drops leaves, twigs and all sorts onto our cars, whats the laws regarding getting it cut back?
Do we ask the owner nicely? (A real chavvy family none of them work)
Cut it back ourselves?

  • If you own the land where the tree is hanging over, then ask the tree owners, nicely, if they would mind cutting it back. If they can't or won't then you are within your rights to cut it back yourself, but you must then offer the cuttings back to the owner.

    Try and keep it nice, maybe they are not able to cut the tree back. Could be a nice be of exercise on a Saturday afternoon if you are feeling fit yourself!:j

    I believe a land-owner is allowed to cut back a tree overhanging his property (council recently told me I was allowed to cut back their trees which overhang my garden).

    Who owns the communal parking area? Joint ownership? Is it managed in any formal way ie by a management company? If not (and I'm guessing here) then if a majority of the owners voted to cut the tree, then I'd guess they could do so (though only where it overhangs.

    In the interests of good-neighbourlyness, and diplomacy, I'd suggest discussing it with the tree owners first, even if you anticipate a negative response. Then at least you've tried.

    If you are not in a Tree conservation area it's a case of being nice to the neighbours, however horrible they are, and getting them to agree to either cut it back or getting your management company to do it.
    I'm not cynical I'm realistic :p
