Hi guys, hope someone can help!
I was a victim of fraud a few months ago where a guy sub-let a flat to me and did a runner with my cash. subsequently i was evicted from the flat and put into temporary accommodation. and i am just getting my feet back on the ground again as i move into my new flat this weekend :-) !
I have been through the small claims court and won my case. the offender has been ordered to pay money due to me and i need to know how to go about finding him and getting him to pay.
I have his mothers address - which was on the tennancy agreement he had with the letting agency. but the police say they can't find him there, so have issued a warrent for his arrest. He is due me over £1000 and i really could do with it.
Can anyone help and advisee me what path i should take from here as i have done everything by the book so far. It could be a nice christmas if i get my money back!

Hang on, are you sure the police have issued a warrant for his arrest just for this or has he done this on more than one occasion and is well known to the police?0

I agree. The police do not enforce civil court judgements.
For the police to be involved they must be investigating a criminal offence, which may or may not be related to the subject of the small claims court case. I'm surprised they have got involved at all in this case as they would normally dismiss it as a 'civil matter'.I'm a retired employment solicitor. I very much doubt you'll get your money back. The cout can issue a judgement but if the person cant pay or you are unable to find him you won't get your money back.
It may be worth speaking to the court appointed bailiffs for advice but to get them to chase collection will cost you money.0 -

i reported him to police after i found out i was conned and because there was money taken they are investigating it as a criminal offence (fraud). it has taken over 3 months for anything to happen but eventually he was reported for warrent (not sure of the exact wording - but next time he gets stopped at a checkpoint or police get called to his house he will be arrested).
this was done seperate to the court procedures. he never responded to the claim and the court rulled (with all the evidence against him) to grant decree for payment.
i thought i might be able to get debt collectors (sherriff bailliffs) to find him. i have his full name and home address, the registration of the car he drives, a photocopy of his passport... he really did leave a big trail behind him!
i dont know the cost of the bailliffs but i suppose it would be worth enquiring because as of now nobody is doing anything about it.
can someone tell me how much bailiffs cost and/or where i can find them??0
