Ending contract for faultyphones - have I any rights?

I can kind of see that, and the chap I spoke to said as much, but surely it's implicit that the price of the phone is included in the contract, as the same company offers the same minutes/texts for half the price with an inferior product, which is all they are offering me!
If the minutes/texts were the sole product, then all phones should cost the same per month, but as we all know, that isn't the case, and cheaper phones have cheaper monthly costs...
Don't get me wrong, I do agree with the sentiment that the contract does include the price of the phone, but it's what's written in the contracts T&C's that you agreed to that's important.
As the T&C's state that the phone is not included, there's no way out i'm afraid.
You try reasoning with them again, if they offer you a refurb iphone for free, then I would take it. My refurb hasn't had a problem.:exclamatiTo the internet.. I need to complain about something!0 -
Thanks for the replies. I'd happily take a refurb iPhone, or a refurb Dell Streak... but they won't give me a Streak as they have none and are getting no more back, which I think is out of order. The other phones are not phones I'd ever have ordered, so it just seems crazy that through no faul of my own, they can send me defective goods, then offer me an inferior product, and I'm still stuck in their contract. Ah well, I'll try more reasoning with them and hope then, since it seemsI have no rights to what I've ordered. Crazy...!

Personally if you want to stick with Android as an OS.. get a Desire.
It's in stock on the website, after looking around, it's a whole lot less buggy than the streak will be and it's not dell!:exclamatiTo the internet.. I need to complain about something!0
