Forgotten payment

Ok, dopey girl from the holiday company took the payment for the flight but forgot to take it for the accommodation :D

Now they've realised and are chasing payment, I didn't realise it hadn't been paid at the time and 'ahem' don't quite have the full amount available at the moment as I might have spent it....(yes I know I should look at statements.....)

What's the situation, do I have to cough up immediately or do I just not answer the phone ;)

    From Beith by any chance?
  • You'll have to pay it, OP. They have 6 years to issue court proceedings for the debt, so if you don't pay, it could be hanging over you for a long time.

I'm sure your girlfriend will be 'well impressed' when you are trailing around lugging baggage trying to get a hotel...no jiggy jiggy for you! She'll laugh her a**e of when you explain you knew! Shame it's as close as you'll get!
  • Sorry, should just explain......we've already had the holiday!
  • They can still take you to court and you could end up with a CCJ against you if you don't pay up, which would do serious damage to your credit file. My advice would be to offer a them a reasonable plan to pay them the money.
  • Agree with scottishblondie..... offer them a set amount over a set period of time to pay it off, as long as your reasonable they should accept it :A
  • Unfortunately the fact that you have had the holiday doesn't exonerate you from your obligations under the contract. You will have to pay the outstanding amount for the accommodation. However, there has clearly been an error on the part of the holiday company, so in the circumstances you may get away with staggering payment for the remainder as has been suggested above. Ignoring this issue will not make it go away though. Sorting out a solution now will avoid any legal repercussions in future, which could potentially come with further expense.
