advice on understanding Shop refund policies

Hi,

I'm doing this on behalf of a friend as I'm not to sure on the answer.

Right here we go.

My friend is a sales assistant in a popular older ladies clothes shop and the other day the manager called a staff meeting, at the meeting all staff were told that when a customer returns an item for a refund for whatever means (stast rights not effected, so faulty goods still get normal refund) they would honor the refund but by gift voucher only. ( i've checked this out on line and the shop is within their rights to do this)

now what my friend is worried about is at the till point is the store return policy and it states that If you are not completely happy with your purchase ********would offer a full refund if the item is returned within 28 days in the condition it was sold, i.e tags attatched. stat rights not effected.
when this was pointed out to the store manager she said that it was up to the company how they offer the refund and as long as it didn't state'' we will refund your money back to you the way you paid'' then they were within their rights to only offer gift vouchers!!

Please could you confirm this as shes worried about angry customers pointing out that it states full refund.

    Why don't you just give the name of the shop instead of skirting around it? They can't track you down from your post or anything?

    Naming employers isn't wise.

    If any arguments arise, point them in the direction of the manager to explain the misleading sign. A credit note isn't a refund.

    I think it might be a bit of a grey area...customers would actually get a 'refund' which is more than their statutary rights. Are you sure it says 'full refund' as online it just says 'refund'?     I'd say the likelihood of any consequences for the person coming from naming the employer in this thread are pretty much non-existent.

    The likelihood may be slim, but it's not your career, work relationships, or friendship on the line should the manager stumble upon this thread at some later point. Posting too much information can have consequences.

    There have been plenty of incidents of people mentioning employers/colleagues/friends/family on here and on social networking sites that have had consequences. However unlikely, it's possible, and adds nothing to the thread.

    Companies trawl these type of sites for any mention of their name.

    well seeing as the op quite clearly said they were posting on behalf of their friend I think its quote unlikely that there going to fore somebody who doesn't work there...... It's not as if they can track down the friend either so I see no worry....

  • A gift voucher is a product that is purchased from the store itself. Therefore to my mind giving someone a gift voucher when returning items is an exchange, not a refund. I would have thought that the manager is on shaky ground here. Of course there is no statutory duty to refund or exchange products that are not faulty, but if signs are displayed and the store voluntarily works those terms into the contract then it will have to deal with them appropriately. It is a matter of interpretation, but I would have thought that if the manager was to argue in an official forum that gift vouchers constitute a 'refund' he would be in some difficulty.
