PCN received for yellow box junction

Options
I received a PCN for being stopped in yellow box junction. I was driving a HGV at the time and yes i do know the laws of the road including yellow boxes. At this yellow box in Highgate North London, I was approaching the junction and slowed down my speed to judge whether i could get across the junction and get the whole of my vehicle across and clear of the hatching. There are two lanes on the approach and two lanes on the exit side. on the exit side, approx 100 yards up from teh junction, there are parking bays and any vehicles in lane 1 have to come across into lane 2 where i was. Cars tend to start pulling over into lane 2 as soon as they are on the exit side of the junction. So any space that is in lane 2 when you cross over can be taken up by other cars by the time you get there and if that space is taken, then your screwed and if your driving a long vehicle, then thats when you get photographed. When your driving a heavy vehicle then acceleration and speed is not with you, so any car drivers who are eager to get home will undertake you and nip across in front of you.

I have uploaded the junction in the below link:

I have done alot of reading into this and i'm looking at an appeal. If they do not take my honest word that traffic in lane one have come into my path and blocked my gap that was there on my approach, then i will try the regulations card. I have reserched the traffic signs guidleines and i believe that this yellow box is illegal. The yellow hatching does not meet up with the kerb which is illistrated in the DFT guidelines.
My question is..................Is the yellow box illegal as the yellow line is a metre away from the kerbside. Illistration in following link:

As you see in the photo, on the other side there are cars a nd a bus trying to move over in to lane 2 from lane 1. The cars joing the exit from the right are also stuck in the similar position that i was in and stuck in the yellow box due to the cars taking up the space as they attempt to get from lane 1 into lane 2.

There is a similar story on this link where it was also stated that the markings were incorrectly painted.:

It says in the 5th paragraph that the lines did not meet the kerb.

a little long winded but i like to get all info out in the first instance. Have i got a case??????

If you're exit was clear when you entered the box then there is no case to answer! I would make an appointment to view the video.

Post here http://forums.pepipoo.com/index.php?showforum=30 for expert advice, including the box markings legality.

Good luck with that. I got one for a similar thing at the roundabout at the top of the Tyne Tunnel. Cars at the entry onto the roundabout ahead of me ignored the rules of the road and pulled out, taking up the 50ft I'd left myself resulting with about 2ft overhanging the yellow box. Two coppers stand on the island every morning watching and take down reg numbers. Even though they'd witnessed what was going on, I lost. I vowed from then on to simply not enter the roundabout unless I could clear it which, with the pig ignorance of the car drivers, means I'd be sat there blocking the A19 south for an hour or so until traffic levels dropped. But at least I'm not breaking the law....

I think you've got a case, there was a user here who seemed up to speed on this sort of thing, a while back. But I'm not sure who it was.

    Have you seen this?

The Sheikh v London one is a real eye opener! Probably not relevant to you though
  • Thanks to you all. I have been through ticketfighter and place of good info which is where i have spent alot of time reading through. I'm pretty sure i have a case on technicality but i also filmed the area today and filmed two lanes of vehicles crossing over and then it all comes to a standstill as the cars from lane 1, move into lane 2 then leaving the innocent guy in lane 2, sat in the yellow box which is what happened to me. Some body elses fault.
Thajks to you all. will update as i continue correspondence.
