Disibility Element WTC

Hello,
I claimed the disibility element of WTC from July 2009, i had been unemployed and on higher IB for over a year until getting a job in July 2009. I had my renewal through and confirmed all the details and that i was eligible for the disibility element again for this year. I have today recieved a letter asking for proof of why i'm eligible for it. Now i'm not sure if i am?! I don't get DLA. Does the fact that i was on higher IB in last tax year still make me eligible ( i also meet a couple of the criteria on the list thing they have, ie cannot stand unaided too long etc)
Hope someone can help as i'm worried about overpayments now and i have tried to look myself online for info but it seems unclear.

I was under the impression that you had to be getting dla to get the tax credit element of disability.0 -

That is a common misconception. I got the element last year due to being on higher rate IB for at least 6mths before going into work and also satisfying the disadvantage test. The confusion comes now as to some guidance suggests that as long as i qualified under those rules and still have the disadvantage then i am still entitled but some guidance suggests that i would have had to have been on the benefit within the past 6mths.0 -

you should still get it... this is because you are at a disadvantage of getting a job, and if you can not do a 5 day / 8 hour day job...
if you were entiltled to the disabilty element within the last 56 days then you can continue to recieve the disability element0
