Help!!! Speeding Ticket Help!!!!!!!!!!!!!!!

i have decided to appeal my speeding ticket as i was goint 36mph in a 30mph zone

I was driving at the steady speed within the speed limit, but due to the road sloping downhill my speed had incrementally creped up to 36mph unintentionally. The mobile traffic camera van was as the end of the slope and therefore it allegedly recorded me over the limit. If the mobile van had been further away from the downward slope of the road, my speed would have naturally corrected itself quickly and returned to within 30mph from the alleged 36mph. Any speed infringement would have not been intentionally

i was just wondoring if this appeal may be worth submitting or not

does anybody know what the process is? - i don't want to take it to court as this a risk and the court always side the side of the cops. if i do appeal it, do i have the options afterwards to accept the 3 points and fine before going to court (if my appeal was not sucessful)

any help would be appreicated

    No - you were speeding. Any appeal would have to be based on a technicality like the camera wasn't calibrated, signs were impropally placed etc.
  • Speeding is speeding, even going down a hil you are supposed to control your speed.

    Just because you are going down a hill does not mean you can break the speed limit.

    As much as i hate speed cameras i doubt u would get off with this excuse. Also you would leave urself open to a charge of some along the lines of not being in control of a motor vehicle. Take the 3 points and use it as a lesson :) (PS i really hate speed cameras and wish they had never been invented :mad: )

    what i would do is send off your cheque for the speeding fine, but include a letter of appeal, perhaps asking when there cameras were calibrated etc
    also make sure there was a camera sign near where the van was - not sure of the technicalities, but if the camera sign is a different colour than the law states it should be then you can get off
    i didn't get off my speeding ticket by doing this, but i've got off my parking tickets by sending off my cheque along with a letter (and sometimes photos) - i've only had 2 mind you, i don't want people thinking i do it often!!!

    I agree with the 2 above posts but to say the camera was on a hill & you couldnt control the speed wont cut the mustard in court!

    Its an adverse situation & the scales tip in the way of the law im afraid (As does with everything!)

    Unless you can think of a 'better' more valid reason Im afraid 3 points are looming
  • Like they say, just pay the fine and collect the points.
    Next time you're going down a hill in a 30 limit and you find your speed is creeping up, use the 'camera cloaking device' fitted to all cars; between the clutch and the accelerator, you'll find a third pedal. Press this with your right foot....
    I detest camera vans located for income generation rather than safety. I got caught on the M4 in S.Wales early one morning on an allbut empty road. No safety risk at all, but I know the law and therefore accept my punishment!

    unintentional or not you were technically speeding and in my opinion there is no point in appealing. There is a saying that not knowing the law doesnt exclude you from obeying the law and there should be a saying unitentionally breaking the law does not exclude you from obeying the law lol. Anyway, manslaughter can be unintentional but you dont see them getting off scot free.......... usually

    No it was you not using the brake, small pedal between clutch and accelerator ;)
