Share certificate never arrived

My wife sent 8 share transfer forms with share certificates to the registrar, Equiniti. She recived 7 share certificates back in her name, the 8th never arrived.

Equiniti say they sent it by Royal Mail First Class (not Recorded Delivery) and if my wife wants a replacement certificate she must pay £69.36 for "Admin & Counter Signature".

As they never delivered the share certificate in the first place, can they require this fee for a share certificate?

    Were the 7 certs in one envelope or 7 individual ones?

    My thinking is if 7 individual ones then 8th is lost in post, but if 7 in one envelope then Equiniti have miscounted

    I bet you will find somewhere on the transfer form that the posting is your liabilty, and thus lost in post is your problem as well

    The certificates were in separate envelopes for each company.

    There is nothing on the transfer form about liability but they or the company (Misys) may have disclaimers we have not seen.

    This gets raised regularly. I think you will find that all share certificates are issued at the shareholder's risk. I now send all share certificates by recorded delivery which probably helps and gives insurance up to £41.00.

    I would like to see registrars offering to return certificates by recorded delivery, even if they charged the shareholder the cost of 74p in addition to the postage.

    That is what is so frustrating.
    My wife sent the original certificates and transfer forms by Recorded Delivery (Signed for) but the registrars do not bother, just stick it in First Class, then sting you for £69 if it does not arrive.
  • Isn't there an issue with duty of care here? If it's not in their T&C then surely they should return it by the same means you felt was required to send them, especially something of such high value?

    Ask them to prove that they posted it with independent means (basically this is recorded delivery), you can prove it arrived. When they can't then say you don't hold grudges if they just pop another one in the post recorded delivery that'll be fine. When this fails start talking about them being a scam and obtaining money by deception (this strikes fear because it's criminal not civil accusations and you're never get charges pressed), start demanding they tell you how many reissues they make, compare this to amount post office lose and use this baseless statistic as your proof - you just create such a fuss they'll just give up and give you another one to get you off their back. This normally works as long as you have the time, it works a treat in a public place.

    If you fail, let me know what legal terms they use. We send out loads of things out recorded delivery, I suggested we just stop and take the cost for the occasional questioned repeat order (to general horror). I never thought to charge our customers for our own incompetence - I have much to learn of these evil ways.
